Professional Fees & Other Charges
Professional fees:
Except as otherwise agreed in advance:
Arbitration: $400 per hour for hearings, study and other necessary work.
Mediation: $400 per hour for mediation sessions, study and other necessary work.
Consultation and Expert Witness Fees: $400 per hour or as otherwise specifically negotiated.
Out-of-pocket expense: reimbursable.
Except for preliminary hearings, the minimum time charge for any hearing, session or meeting noticed or confirmed to the parties is five (5) hours.
Cancellation fees:
Hearings, sessions or meetings noticed or confirmed to the parties are scheduled only as a consequence of the agreement of the parties.* Dates reserved on my calendar oblige me to decline or delay other work that may conflict with the schedule thus established. Accordingly, cancellation fees are chargeable, except in case of medical or personal emergency suffered by a necessary participant, when hearing dates confirmed in writing as scheduled (whether by formal notice of hearing or otherwise), for which I remain available to serve, are cancelled or otherwise postponed for any reason, whether at the instance of one or more parties or otherwise, as follows:

*Note on scheduling agreements in arbitration: In the rare instances in arbitration in which parties, with the help of the arbitrator, are unwilling or unable to agree upon a schedule, the arbitrator's authority to enter a binding scheduling order derives from the underlying agreement that brings the matter into arbitration.
In-person hearings, sessions or meetings:
For any cancellation on a date on which a hearing or session is scheduled: $400 per hour for each scheduled hour (minimum charge: five (5) hours, except in-person preliminary hearings and meetings of indeterminate length: 3 hours).
For any cancellation one day to one week in advance: $2,000 per date (except in-person preliminary hearings and meetings: $1,000).
For any
cancellation (except in-person preliminary hearings or meetings) one
to two calendar weeks in advance: $1,200 per date.
For any cancellation (except in-person preliminary hearings or meetings) 15 to 30 days
in advance: $1,000 per date.
For any other cancellation of hearing or session dates that have been on calendar for 30 days or more at the time of cancellation: $200 per date.
Conference calls:
For cancellation of any conference call (other than the first preliminary hearing in a case) cancelled three or fewer business days in advance: $400.
Waiver of specific cancellation charges, in whole or in part, will be considered upon request and upon an appropriate specific showing.
Travel Time:
No charge is made for travel time for intercity travel outside the Greater Bay Area. Travel time is charged (at one-half the otherwise applicable hourly rate) only for:
Repeated local travel to and from hearings requiring one-half
hour or
more each way.
Travel to and from any duly noticed site visit.
General:
Fees and charges are subject to negotiation, in advance, in cases
of established
hardship or where other special circumstances may
warrant.
